BioGuard Miami, LLC ("BioGuard," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you visit bioguardmiami.com (the "Site") or request mold, Legionella, or indoor air quality assessment services from us (the "Services"). By using the Site or Services, you agree to the practices described below.
1. Information We Collect
Information you provide. When you request an inspection, complete a contact form, book a visit, or correspond with us by phone, email, or SMS, you may provide: full name, phone number, email address, property/mailing address, preferred appointment date, property type (single-family, condo, HOA-managed, hotel, short-term-rental), occupancy details relevant to indoor air quality (occupant counts, sensitive occupants, prior water events), and any notes you choose to share.
Inspection records. During a visit we collect photographs of accessible areas, moisture and temperature readings, air and surface sample chain-of-custody data, laboratory results, and signed authorization forms. These records form your written report and are retained in accordance with Florida law.
Information collected automatically. When you browse the Site we collect IP address, approximate geolocation derived from IP, browser type and version, device identifiers, referring URL, pages viewed, and timestamps. We use first-party cookies and similar technologies (described in §6) for session management, fraud prevention, and aggregate analytics.
2. How We Use Information
- Schedule, perform, and follow up on inspections you request.
- Deliver written reports, lab results, and supporting documentation.
- Send transactional SMS, email, and phone updates related to your visit (see SMS Terms).
- Operate, secure, debug, and improve the Site and Services.
- Comply with Florida DBPR record-keeping under Chapter 468, Part XVI and applicable federal, state, and local law.
- Detect, prevent, investigate, and respond to fraud, abuse, security incidents, and unauthorized access.
- Aggregate de-identified statistics for internal quality control and our public Miami Watch outbreak-monitoring feature.
3. How We Share Information
We do not sell or rent personal information. We share only with:
- Service providers bound by written contracts — scheduling, SMS/email delivery, AIHA-LAP accredited laboratories, cloud hosting, and IT security vendors.
- Authorized recipients you designate in writing — for example your HOA board, property manager, insurance carrier, attorney, or remediation contractor.
- Legal and safety — when required by law, subpoena, court order, governmental request, or to investigate and defend against legal claims, protect rights, safety, or property.
- Business transfers — in the event of a merger, acquisition, or asset sale, subject to confidentiality protections at least as protective as this Policy.
4. SMS, Email & Phone Communications
By submitting a booking or contact request, you consent to receive transactional SMS, email, and phone communications from BioGuard Miami at the numbers and addresses you provide. 5. Data Retention
Inspection records, signed reports, sample chains-of-custody, and laboratory results are retained for a minimum of five (5) years in accordance with Florida Statute Chapter 468, Part XVI. Records may be retained longer when reasonably required for litigation hold, insurance, or regulatory inquiry. Marketing and form-submission data not tied to a completed inspection are retained for up to 24 months and then deleted or de-identified.
6. Cookies & Tracking
We use strictly necessary first-party cookies to maintain session state and protect against form abuse, and aggregate, privacy-friendly analytics to understand traffic patterns. We do not use cross-site advertising trackers. You can refuse cookies in your browser settings; doing so may impair booking-form functionality.
7. Your Rights
Subject to applicable law, you may request: (a) access to the personal information we hold about you, (b) correction of inaccurate or incomplete information, (c) deletion of personal information (subject to our regulatory record-keeping obligations), (d) a portable copy of your information, and (e) to opt out of non-essential communications. Florida residents have additional rights under the Florida Digital Bill of Rights; California residents under the CCPA/CPRA. Submit requests to hello@bioguardmiami.com with the subject line "Privacy Request." We verify identity before responding and reply within 45 days.
8. Security
We use industry-standard administrative, physical, and technical safeguards — encryption in transit, access controls, vendor due diligence, and least-privilege provisioning — to protect personal information. No transmission over the Internet is ever completely secure; we cannot guarantee absolute security and you transmit at your own risk.
9. Children's Privacy
Our Services are directed to adults. We do not knowingly collect personal information from children under 13. If you believe a child has provided information to us, please contact us so we can delete it.
10. Third-Party Links
The Site may link to third-party websites (e.g. myfloridalicense.com, AIHA-LAP). We are not responsible for the content or privacy practices of those sites. Review their policies before providing information.
11. Changes to This Policy
We may update this Policy from time to time. Material changes will be posted on this page with a revised "Last updated" date. Continued use of the Site or Services after a change constitutes acceptance.
