These Terms of Service ("Terms") govern your access to and use of the bioguardmiami.com website and any indoor environmental assessment services provided by BioGuard Miami, LLC ("BioGuard," "we," "us"). By booking an inspection or using the site, you agree to these Terms.
Scope of Services
BioGuard provides assessment-only services: visual inspections, moisture mapping, air and surface sampling, Legionella sampling, indoor air quality measurement, and written reporting. Under Florida Statute § 468.8419, we do not perform mold remediation, water-damage repair, HVAC service, or plumbing work, and we do not accept compensation from remediation contractors for referrals.
Standards Followed
Our work follows IICRC S520, ANSI/IICRC S500, ASHRAE Guideline 12, ASHRAE Standard 188, EPA mold remediation guidance, and Florida Chapter 468, Part XVI. Laboratory analysis is performed by AIHA-LAP accredited third-party laboratories.
Reports & Limitations
Reports reflect conditions observed and samples collected at a single point in time at accessible locations. Reports are not a medical diagnosis, legal opinion, real estate disclosure, or warranty of future indoor conditions. Sampling results are interpreted in context with site conditions; non-detection does not guarantee absence of contamination. Concealed conditions inside wall cavities, slabs, or mechanical chases may exist even when not identified.
Free Inspection Offer
Complimentary inspections are limited to one (1) property per household or owner per twelve (12) month period, within our service area (Miami-Dade and Broward counties), subject to scheduling availability. Laboratory analysis, post-remediation verification, expert testimony, and travel outside the service area are billed separately at published rates.
Scheduling, Cancellation & Access
You agree to provide safe, lawful access to the property at the scheduled time. Cancellations with less than 24 hours' notice or inability to access the property at the scheduled time may forfeit the complimentary visit.
Payment
Paid services (lab fees, follow-up testing, post-remediation verification, expert reporting) are invoiced upon completion and payable within fifteen (15) days. Past-due balances accrue interest at the maximum rate permitted by Florida law.
Disclaimer of Warranties
EXCEPT AS EXPRESSLY STATED, OUR SERVICES AND THIS SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
Limitation of Liability
To the maximum extent permitted by Florida law, BioGuard's aggregate liability arising out of or related to the services or these Terms shall not exceed the fees paid by you to BioGuard for the specific inspection giving rise to the claim. BioGuard shall not be liable for indirect, incidental, special, consequential, or punitive damages.
Indemnification
You agree to indemnify and hold harmless BioGuard, its employees, officers, and contractors from claims arising out of your misuse of the report, your failure to act on documented findings, or your breach of these Terms.
Governing Law & Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Exclusive venue for any dispute is the state and federal courts located in Miami-Dade County, Florida.
Changes
We may update these Terms periodically. Continued use of the site or services after changes constitutes acceptance.
